Course Description
How can competitors collaborate without violating antitrust laws? Attorneys from the U.S. and Europe weigh in with their perspectives, joined by antitrust officials from the U.S. Department of Justice, the Federal Trade Commission, and the European Commission. Participants examine the U.S. and E.U. approaches to the antitrust analysis of joint ventures under their respective guidelines, with input from an economist on the evolution of joint venture activity over the past decade. Particular attention is given to the Polygram Holding (Three Tenors) case, the first case of competitor collaboration decided by the FTC since the issuance of the 2000 DOJ/FTC Guidelines for Collaborations Among Competitors.
